1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Motho platform, website, and related services ("Services") provided by Motho (Pty) Ltd ("Motho", "we", "us" or "our"). By creating an account, using our Services, or accessing our website, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

2. Definitions

In these Terms, the following words have the meanings set out below unless the context requires otherwise:

• "User" means any person or business that registers for or uses the Services.
• "Seller" means a User who connects an online store or otherwise books shipments through the Services.
• "Courier Partner" means a third-party courier or road-freight company integrated with Motho.
• "Shipment" means any parcel, pallet, or freight item booked through the Services.

3. Eligibility and account registration

You must be at least 18 years old and legally capable of entering into contracts to use the Services. You agree to provide accurate, current and complete information during registration and to keep it updated. You are responsible for all activity that occurs under your account.

4. Free and paid services

Motho offers a free entry tier and paid subscription plans. Fees, limits and feature availability are described on our Pricing page. We may change pricing or plans by giving you reasonable notice. Optional courier charges, fuel surcharges, remote-area fees and other third-party costs are passed through as quoted at the time of booking.

5. Courier services and liability

Motho is a platform that connects Sellers to Courier Partners. We are not the carrier unless explicitly stated. Risk and liability for the physical carriage of goods remain with the Courier Partner, subject to the terms of that Courier Partner and applicable law. Motho uses reasonable efforts to display accurate rates and transit times, but these are provided by Courier Partners and may change.

You must ensure that shipments are accurately described, correctly packed, and comply with all laws and the Courier Partner's terms. Prohibited or dangerous goods may not be shipped through the Services.

6. Data and privacy

Your use of the Services is also governed by our Privacy Policy. We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable laws.

7. Intellectual property

All content, trademarks, software, and materials on the Motho website and platform are owned by or licensed to Motho. You may not copy, modify, distribute, or reverse-engineer any part of the Services without our written consent.

8. Indemnity and limitation of liability

To the maximum extent permitted by law, you agree to indemnify and hold Motho harmless from any claims arising from your use of the Services, your shipments, or your breach of these Terms. Motho is not liable for indirect, consequential or punitive damages, or for losses arising from the acts or omissions of Courier Partners.

9. Termination

Either party may terminate the account relationship at any time. We may suspend or terminate your access if you breach these Terms or create risk or legal exposure for us. Upon termination, your right to use the Services stops immediately.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be resolved in the courts of South Africa.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Services. Your continued use after the changes take effect constitutes acceptance.
